Irksome arguments

  • “This has stopped terrorism” - if it has, then show us. 
  • “We have to make choices… How are we striking this balance between the need to people to keep people save and privacy” - yes, yes, we do. So why is this all done in secret? And why are we only having it now because SOMEONE LEAKED SOMETHING?
  • “They may identify potential leads” - then get a freaking warrant just like we’ve had to do for the last 250 years
  • “Nobody’s listening to the content of your phone calls” - First off, right, yeah, sure, and secondly, that’s like saying “no one is dying” to a rape charge. It’s still offensive. 
  • “With respect to emails this does not apply to US citizens and people living in the United States” - the program exists
  • “They are legal” - no one is outraged because it’s illegal. They’re outraged because it exists.
  • “There’s a reason why these programs are classified…because when it comes to, for example, fighting terror, our goal is to stop folks from doing us harm and if every step we’re taking is on the front pages of the paper then presumably the people who are trying to do us harm are going to be able to get around our preventative measures” - yes because terrorists were totally assuming Gmail was completely safe. There are no foreign email services. In which case, hey, they know now, SO STOP IT. I’m sure terrorists were just assuming Gmail was safe before. 
  • “If people can’t trust not only the executive branch but also don’t trust congress and don’t trust federal judges to make sure we’re abiding by rule of law… then we’re going to have some problems” - YES WE DO THAT IS EXACTLY THE POINT. 

Also, you know that terrorists can strike us all the time, right now, right? Wacky teenagers get an idea in their head, google a few things, buy some shit at Wal Mart and can BLOW PEOPLE UP. It just happened. If terrorists are after us constantly, why isn’t this happening every day?

Here's the running list of comment the key players have given CNN on PRISM.

Microsoft (also Skype): "We provide customer data only when we receive a legally binding order or subpoena to do so, and never on a voluntary basis. In addition we only ever comply with orders for requests about…

Totally worth reading all the way through. CNN suggests that the information from Google et al is being provided at the Telecom level.

I tweeted this earlier, but my bet on what's happening.

1) The government has required the companies to expose a web service to them that supplies the information that they need and can legally compel the companies to provide. 

2) They have agreed that the only requests going through the web service have been clearly approved via the FISA Courts, either by direct warrant or blanket approval of certain types of pre-approved queries, within the law, and within their authority. 

3) The providers would have to provide this information anyway, as the laws and FISA clearly allow it. So they automated it. 

4) PRISM is an NSA internal code name. 

With all of these things being true, Prism could totally exist, there would be no direct connection to the company's servers, and they could claim that every legal request was complied with and reviewed - in the sense that the web service request would require some sort of "FISACourtApproval=YES&Required=YES" variable string that made it clear to the company that the legal needs had been met, and they have to comply. They have no choice.

Were all this the case, a company can totally say "we've never heard of prism, we do not allow the government direct connections to our servers, and we only comply when we have to and we have reviewed the info."

They don't specify the review isn't automated. 

And the FISA courts have applied a blanket approval to the situation within certain gidelines. This would allow literally millions of requests a day, and more or less instantaneous ones.So it would still be true that the NSA could watch ideas form almost as you type.

You will notice that Senator Wyden did not say that the surveillance "is the one I have been concerned about for years." He just said it is ONE of them. 

This is someone routinely briefed on the government's security apparatus, but barred from talking about it. 

I'm not a conspiracy freak but I am a betting man. And I'll bet there's much more going on than just phone metadata and PRISM.

Ouch.

Of course this begs to question, do the Blue Album and Pinkerton rock less simply because everything Weezer has released since then sucks? Maybe? When was the last time you thought "Man I want to listen to that awesome Bad Religion song!" probably not since '92. But what if No Control was the last record they ever put out? It might be a lot more often. What if Red Hot Chili Peppers broke up after The Uplift Mofo Party Plan? Would you want to die right there on the spot anytime a DJ says he's playing one of their songs next?

But who's to say Joy Division would have started release half assed songs? When The Mars Volta and Sparta rose from the ashes of At The Drive In it was pretty damn obvious where the talent was and wasn't. But New Order's catalog (especially the first 10 years or so) suggests that the all songwriting genius didn't die with Ian. We lost his lyrics of course, but he was a pretty morbid fucked up guy to begin with and I think it's a stretch to suggest if he'd lived he would have cheered up somehow. I mean, Rivers Cuomo is a weird guy too, but come on now, does anyone think there's a world where Ian Curtis could have written the equivalent to 'Heart Songs' or 'We Are All On Drugs' or 'Cold Dark World' or named an album something like Raditude?

Not since The Wizard has a movie been so in the bag for a corporation. It's incredibly difficult to watch The Internship as simply a movie and not as a two-hour long recruitment ad designed to congeal the vaguely warm feelings most people harbor for the company into a wet pap of "Googly" propaganda. You can watch The Internship as the classic buddy comedy it tries to be — but you shouldn't.

Between this movie and the new Eric Smidt book, I think basically Google has turned over all of its marketing to the freshmen "introduction to marketing" class at the local community college.

Such an icon of New York.  I didn't really miss the passing of Tower Records despite the hours and days I spent there, but Bleecker Bob's was an institution.

I used to take the bus down from Boston in the early 1990's to hit Bleecker Bob's (and, for a while, Generation records). They were, at the time, the best record stores in America. That mantle fell to Ameba some time ago, but.. God. Bleecker Bob's.

Several years ago, and shortly after she joined the service, my wife looked up from her screen with a virtual light bulb above her head and said: Pinterest is my Google.

Now, I wouldn't call Pinterest a general purpose search engine yet, but if we need a recipe or an image or ideas for a project around the house or new product recommendations, our family generally turns to Pinterest. And the results are far superior to Google.

In reality, I'm finding my own usage of Google as a search engine is pretty much for finding things on Wikipedia and Youtube (or on my own site- c'mon Tumblr!).

And I'm finding that across most of the things I search for these days. If I want a new restaurant, I search Foursquare. If I want new music, I head over to Hype Machine or see what my friends are listening to on Rdio. If I want up to date news, I search Twitter. And the list goes on.

Perhaps we've seen the end of general purpose search. Or, perhaps we're just seeing more evidence that the best way to compete with incumbents is by not competing with them at all- until you do.

The logged out Tumblr search is one of the best searches on the web.
